This page contains frequently asked questions regarding Kentucky DUI program policy, for the purpose of informing DUI providers and the public. Click on a question below to display the answer.

Assessment Questions

• What percentage of assessments is referred to programs provided by the assessing agency?
• What are the options for a client who has been assessed as inappropriate for class or group due to medical problems – such as active cancer chemotherapy, chronic pain or disability – that makes being seated for an hour difficult?
• Do the data suggest that assessors are primarily and predominantly "under" referring or self-referring? That is, clinically not referring a client to the level of need but referring to the level that the assessing agency offers?
• What is the Division of Behavioral Health's stance regarding free or extremely low cost assessments to generate client assessments and then self-referral?

Education Questions

• If a client receives assessment or education services in a licensed facility that is not a certified DUI program will the assessment and education services count toward fulfilling the requirements for other DUI convictions?
• May education programs be less than 90 days long?
• With regard to the restriction in the regulation that allows for the PRI 20-hour program to be given in three weeks, where is the evidence to demonstrate what is effective and what is not?

Forms Questions

• What is a Memorandum of Understanding (MOU), when do we complete one, and why do we need one?
• Could the courts do a better job of making sure that each convicted DUI offender has copies of his or her Uniform Citation and the Notice to Attend for his or her assessment?
• Must the client be informed of the total cost of DUI services prior to enrollment?

Training and Program Questions

• Is the 12-hour requirement for Clinical Services Supervisor sufficient?  Do we need to adopt Clinical Services Supervisor certification?
• Can the case coordinator reject treatment at other agencies because of time, multiple transfers, and attendance?

Treatment Questions

• If a client receives treatment services in a licensed facility that is not a certified DUI program will the treatment received count toward fulfilling requirements for a DUI conviction?
• How much credit would a DUI offender receive for completion of a 28-30 day residential program in a licensed treatment facility?
• Does the regulation permit a treatment plan for a multiple offender that calls for less than weekly treatment?
• How can a client who is involved with an agency, who then enters residential treatment and leaves against staff advice – either medical or clinical – successfully complete the treatment?
• Do the data suggest that Residential and Intensive Outpatient Treatment are under-utilized by assessors especially with regard to multiple offenders?
• How can an agency report this client's failure to successfully complete residential treatment to the Division of Substance Abuse without violating the client's confidentiality?

Under-21 DUI and Zero Tolerance Questions

• How do DUI providers handle getting Zero Tolerance clients straight from the court?
• Should DUIs for individuals under age 21 with a BAC of .10 go to an Early Intervention Program?
• How do we treat a 19-year-old with a first offense DUI with a BAC of .12 and a first offense DUI with a BAC of .06?
